In a significant ruling, Justice Ibrahim Musa-Muhammad of the Kano State High Court has restrained the Central Bank of Nigeria (CBN), the Accountant-General of the Federation (AGF), and the Revenue Mobilisation Allocation and Fiscal Commission (RMAFC) from withholding funds meant for the 44 Local Government Areas (LGAs) in Kano State.
The interim order was granted on Wednesday in response to an ex-parte application filed by Ibrahim Muhammed, Chairman of the National Union of Local Government Employees (NULGE), and five others. The applicants’ lawyers, Bashir Yusuf-Muhammad and Usman Bala-Salisu, expressed concerns about potential delays or withholding of essential allocations for local governance.
Justice Musa-Muhammad’s order prohibits the CBN, AGF, and RMAFC from refusing to disburse, delaying, deferring, or suspending the monthly allocation from the Federation Account to the 44 LGAs. This restriction will remain in place until the court hears and determines the motion on notice.
Additionally, the judge granted permission for substituted service, allowing the applicants to serve court processes on the respondents. The case has been adjourned until November 21 for further hearing.
This development underscores the importance of ensuring timely and transparent allocation of funds to local governments, enabling them to effectively discharge their responsibilities and serve their communities.
